TERMS OF SERVICE – Makai the Label

1. General information / Seller identification
These Terms of Service (“Terms”) govern the use of the website makaithelabel.shop (the “Website”) and the purchase of products from the Website. The owner and operator of this Website is:

By using the Website and/or placing an order, you (“Customer” / “User”) accept these Terms.

2. Scope of Application
These Terms apply to all orders placed via the Website, and define the rights and obligations of both Makai the Label (the “Seller”) and the Customer. Before placing an order, the Customer must read and accept these Terms; acceptance is confirmed when the Customer clicks “Accept / I agree” (or equivalent) during the checkout process.

3. Products, Orders and Contract Formation

The Seller offers physical goods (clothing, accessories, etc.) listed on the Website.
Product descriptions, prices and availability are indicated on the Website. While the Seller strives to provide accurate information, minor discrepancies may occur.
An order is considered placed once the Customer completes the checkout process and receives an order confirmation (by email) from the Seller. That confirmation constitutes a binding sales contract.
Prices shown at the time of order are final and binding for both parties, provided payment is successfully processed.

4. Payment Methods
The Customer may pay for orders using the payment methods available at checkout (e.g., credit/debit card, bank transfer, other). Payment must be made before order dispatch.

5. Delivery and Shipping

The Seller dispatches orders to the delivery address provided by the Customer during checkout.
Shipping costs, estimated delivery times, and method of delivery (carrier) are specified during checkout or in the shipping information section.
The Seller commits to dispatching ordered goods within a reasonable time, but actual delivery times may depend on the carrier and destination.

6. Right of Withdrawal / Returns & Refunds

If the Customer is consuming as a consumer (i.e., not acting for business purposes), they have the right to withdraw from the contract without cause, within 14 calendar days from the date of receipt of the goods.
To exercise this right, the Customer must inform the Seller (e.g., by email: contact@makaithelabel.shop) before the 14-day period expires, using a clear statement (for example, a letter or email).
After withdrawal, the Customer must return the goods in their original condition and packaging, without undue delay and no later than 14 days from the withdrawal notification. Costs of return shipment may be borne by the Customer (this should be clearly stated). Upon receipt and inspection of the returned goods, the Seller will refund all payments received, including standard delivery costs (if applicable), using the same payment method used by the Customer, without undue delay.
Some exceptions may apply (e.g., personalized/customized products, hygiene-sensitive items), which will be explicitly stated at the time of purchase.

7. Complaints / Goods Not in Conformity / Warranty

The Customer has the right to lodge a complaint if the product received is defective or does not conform to the contract.
The complaint request should be submitted via email (contact@makaithelabel.shop) or phone (+34 662 191 384), including order number, description of the defect or non-conformity, and photos if relevant.
The Seller will review the complaint and, if justified, offer repair, replacement, price reduction, or withdrawal and refund — according to applicable consumer protection laws.
Warranty rights exist under applicable law and are separate from any commercial warranty (if offered).

8. Use of the Website & Intellectual Property

All content on the Website — including but not limited to text, images, logos, designs, graphics, product photos — is the exclusive property of Makai the Label or licensed to it.
The Website’s content is provided for personal, non-commercial use only. Any reproduction, distribution, modification or commercial exploitation — in whole or part — without prior written consent is prohibited.
Use of the Website for illegal purposes or to violate these Terms (e.g., to overload or harm the Website, or infringe the rights of third parties) is strictly prohibited.

9. Limitation of Liability & Disclaimers

To the maximum extent permitted by law, the Seller disclaims any liability for damages arising from use or inability to use the Website, including but not limited to direct, indirect, incidental or consequential damages, loss of data, profits or other losses.
The Website and its content are provided “as is” — the Seller makes no warranties or guarantees regarding completeness, accuracy, reliability or suitability for a particular purpose.

10. Privacy and Data Protection

Personal data collected during the ordering process (name, address, contact details, payment data, etc.) will be processed in accordance with applicable data protection regulations (e.g., GDPR) and the store’s Privacy Policy (which must be provided separately).
By placing an order, the Customer consents to the processing of their personal data for purposes necessary to complete the order (processing payment, shipping, customer service, etc.).

11. Changes to Terms & Validity

The Seller reserves the right to modify these Terms at any time. Changes will be effective once published on the Website.
For any order placed before the change, the version of the Terms at the time of order will apply.

12. Governing Law & Jurisdiction

These Terms and any dispute arising from them or related to the contract shall be governed by Spanish law.
For disputes, the courts corresponding to the Seller’s registered address (Alicante, Spain) will have jurisdiction, unless mandatory law provides otherwise.
